US District Judge Rudolph Contreras on Friday issued a preliminary injunction to halt the restriction, saying the designation of Xiaomi as a Chinese military company is "deeply flawed" and lacks "substantial evidentiary support".

LOS ANGELES -- Video-sharing social networking platform TikTok welcomed a preliminary injunction issued by a federal judge Sunday night against a US administration's order to ban the popular app from American online app stores.

"We're pleased that the court agreed with our legal arguments and issued an injunction preventing the implementation of the TikTok app ban.

The Los Angeles-based company made these remarks after Judge Carl Nichols of United States District Court for the District of Columbia handed down the temporary injunction which granted a short-time reprieve to TikTok and its Chinese parent company ByteDance.

The popular short-video platform requested an injunction on Sept 23 to temporarily block the Commerce Department's order to ban the app.

Late on Sept 25, the Justice Department filed its opposition to TikTok's request, saying the injunction would "infringe on the President's authority to block business-to-business economic transactions with a foreign entity in the midst of a declared national-security emergency".

The government has filed a motion in federal court to stay the WeChat Ban preliminary injunction pending appeal.

Magistrate Judge Laurel Beeler in San Francisco issued the order granting motion for preliminary injunction, which determined the restrictions placed on WeChat could violate the Constitutional Amendment rights of its users in the United States.

Apple later continued to sell the affected iPhone models as the patent infringement ruling only applies to models running the old operating system, leading Qualcomm to ask a court in Fuzhou to enforce the injunction on Thursday.

KON is demanding compensation of 100,000 yuan ($15,200), an injunction against infringing devices such as iPhones and iPads, as well as a public apology.

With regard to the issue at dispute, China said that it is neither the creator nor the major user of the anti-suit injunction and that the domestic courts of many WTO members, particularly in the EU, have issued a considerable number of injunctions in standard essential patents-related litigations.

In a statement, the department cited a preliminary injunction against the ban, ordered by Judge Wendy Beetlestone of the US District Court for the Eastern District of Pennsylvania on Oct 30, following a lawsuit filed by three TikTok content creators.

The request for a preliminary injunction was filed by TikTok's Chinese parent company, ByteDance.
